Cohabitation Agreement

A cohabitation agreement is a contract signed between two people who are living together but not married. This contract can be signed between partners of any gender and any sexual orientation, and it is a good idea for any couple before they start living together.

Antenuptial Contract

An antenuptial contract is a contract entered into by a couple intending to get married. They can be used to protect assets and property, or to outline responsibilities or expectations of each partner. Couples married under this contract are referred to as married out of community of property.

Divorce

Divorce is known as the termination of marriage and its obligations/ responsibilities. A divorce proceeding outlines the division of assets as well as other factors such as who will be the primary care giver of the child (should the couple share responsibility over a child), the layout of visitation rights and allocation of maintenance.

Rule 43 Interim Maintenance

In many cases divorces may leave the non bread winner party without any income, which can then make it difficult to meet their own or their minor children‘s financial needs. The law provides financial assistance to spouses in these instances until the divorce is finalized.

Child Maintenance

Child maintenance is the obligation to provide another person, for example a minor, with housing, food, clothing, education and medical care, or with the means that are necessary for providing the person with these essentials. 

Spousal Maintenance

The aim of spousal maintenance is to help the financially weaker spouse to become financially independent, or to help them to maintain the standard of living that they enjoyed during the  marriage.

Parenting Plans

These plans outline the responsibilities, rights and duties of each parent in the care and upbringing of their children. It is a legally binding document that sets out how the parents will make decisions and share time with their children after a divorce or separation.

Customary Marriage

Customary marriage is a recognized form of marriage in South Africa that is governed by the customs, practices, and traditions of the couple’s culture or community. It is an important aspect of South African family law and is recognized by the Recognition of Customary Marriages Act of 1998.
